Welcome to Verifully (“Company,” “we,” “us,” or “our”). These Terms of Use govern your access to and use of our website (verifully.com), software, API endpoints, and email verification services (collectively, the “Services”).
By creating an account, connecting via API, or using our Services, you agree to be bound by these Terms. If you do not agree, do not access or use Verifully.
1. Account & Subscription Terms
Account Creation: You must provide accurate, complete information when creating an account. You are responsible for safeguarding your account credentials and for all activities that occur under your account.
Credits & Verification Usage: Email verifications, whether conducted via bulk CSV upload or real-time API, consume platform credits. Credits are non-refundable once processed through our verification engine.
Fair Use: We reserve the right to monitor account usage to ensure platform stability and protect system resources against automated abuse.
2. Acceptable Use Policy
You agree not to use Verifully to:
Process lists acquired through unlawful means or without legal authorization under applicable spam regulations (e.g., CAN-SPAM, GDPR).
Attempt to reverse-engineer, decompile, or bypass the security mechanisms of our MX handshake, ISP proxy, or verification infrastructure.
Resell, rent, or lease direct API access to third parties without prior authorization.
Overload, flood, or conduct Denial of Service (DoS) attacks against our servers or API infrastructure.
3. API & Service Availability
Service Level: We strive to maintain maximum platform uptime and rapid API response times. However, we do not guarantee uninterrupted access due to scheduled maintenance, third-party network outages, or ISP rate-limiting adjustments.
Rate Limits: API calls must adhere to published speed and payload limits to ensure service quality for all users.
4. Disclaimers & Deliverability Performance
Engine Accuracy: Verifully utilizes proprietary, multi-layer verification mechanisms (including live MX handshakes and SMTP tests) designed to deliver high-accuracy results (99.5%+ targeting).
Third-Party Variables: While we drastically reduce bounce rates, inbox placement ultimately depends on factors beyond verification (such as sender domain reputation, email copy quality, and recipient server settings). We do not guarantee 100% deliverability for outbound campaigns.
5. Limitation of Liability
To the maximum extent permitted by law, Verifully and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages—including loss of domain reputation, email blocklisting, lost revenue, or data corruption—arising out of your use of or inability to use the Services.
6. Termination
We reserve the right to suspend or terminate your account immediately, without prior notice, if you violate these Terms, engage in fraudulent activity, or misuse our network infrastructure.
